Akhter ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner has been falsely implicated in connection with the instant case. Learned advocate also submits that the petitioner is a sole accused and allegedly recovery of 47 kgs of ganja have been shown. However, there are hardly any materials to connect the petitioner with the alleged offence and the petitioner is unnecessarily languishing for a period of 11 months.

Learned advocate for the State submits that there are overwhelming materials so far as the present petitioner is concerned.

I have considered the submissions of either of the parties and, I find that only one witness has been examined out of the 16 witnesses proposed to be examined.

Having regard to the quantum of seizure, I am of the opinion that the rigours of Section 37 of the NDPS Act is attracted, as such, at this stage, I am not inclined to enlarge the petitioner on bail.

Hence, the prayer for bail of the petitioner is Rejected.

State is directed to conclude at least 10 witnesses by 15th March, 2025.

The petitioner would be at liberty to approach this court, in case, there is any non-compliance of the aforesaid directions. No unnecessary adjournment be granted by the learned trial court to any of the parties and the trial court would proceed inspite of any resolution of the local Bar. Accordingly, CRM(NDPS) 1454 of 2025 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
