Heard learned counsels for the parties.

Perused the case diary.

It appears that over a dispute of constructing a partition wall in a common property, there was an altercation between the two groups of family members.

Considering the materials available in the case diary and the fact that there are allegations and counter-allegations and that both sides received injuries, I am inclined to grant anticipatory bail to the petitioners.

Accordingly, I direct that in the event of arrest, the petitioners viz., Haji Jahangir Ali Sha, Golam Mortaja Sha, Haji Jonab Ali Sha, Rabiul Alam Sha, Rejaul Alam Sha, Jishan Ali Sha & Banti Sha @ Nijmul Hasan Sha, be released on bail upon furnishing a bond of Rs.10,000/-, with two

sureties of like amount each, to the satisfaction of the Arresting Officer and also subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The petitioners shall not intimidate the witnesses and/or tamper with evidence in any manner whatsoever and shall cooperate with the Investigating Officer and shall meet the I.O. once in a week till submission of report in the final form. 6.

The application for anticipatory bail being CRM (A) 3870 of 2025 is, thus, allowed and disposed of. 7.

Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
