The petitioner is aggrieved by the act and action of the private respondent no.4 who, according to him, is threatening.

Mr. Yusuf, learned advocate appearing for the State submits that there is a business rivalry arising out of infringement of trade mark.

Learned advocate for the petitioner submits that the petitioner has approached the Registrar of Trade Marks with an appropriate application and the same is pending.

Be that as it may, the petitioner presently is aggrieved by the act and action of the private respondent who is a resident of Islampur.

According to the petitioner, he has been carrying his business in the districts of Murshidabad and Malda. However, the petitioner has complained against the private respondent no.4 at the office of the Superintendent of Police, Barasat Police District and to the Officer-in-Charge, Barasat Police Station. I direct the State to send the complaint of the petitioner dated 04.10.2024 to the

Superintendent of Police, Murshidabad who would depute to the jurisdictional police station for conducting an enquiry, assess and act in accordance with law.

With the aforesaid observations, the writ petition being WPA 26692 of 2024 is disposed of. There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
