Learned counsel for the petitioner submits that the petitioner approached the respondent authorities but was not given any form for applying electricity connection to operate his submersible pump.

Learned counsel for the WBSEDCL categorically opposes the same and submits that the form is available upon payment of Rs.5/- and there could not be any plausible reason why the petitioner was refused such favour.

Although I do not find any credible case of mala fides being made out in the writ petition for the WBSEDCL to refuse even the opportunity to collect a form for applying for electricity connection, in view of

the petitioner having a right to so apply, W.P.A. No. 25213 of 2023 is disposed of by directing the petitioner to collect from the appropriate authorities of the WBSEDCL a form to apply for electricity connection to operate his submersible pump.

If so approached, upon compliance of all requisite formalities by the petitioner including payment of the price of the form, the WBSEDCL shall ensure that such form is given to the petitioner. 5.

Upon getting such application form, the petitioner will be entitled to file an application for getting such electricity connection.

Thereafter, the WBSEDCL will process such application in due process of law and only upon complying with all due formalities in law, the WBSEDCL shall give such electricity connection to the petitioner.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance of all necessary formalities.
