-versus- The State of West Bengal and others Mr. Sanjib Das Ms. Sandhya Kumari ..for the petitioners Mr. Manas Kundu Ms. Debaleena Dasgupta ..for the State The petitioners claim that an area of land measuring about 18 decimals in Mouza Amodepore, J.L. No. 322 within the jurisdiction of Block Land and Land Reforms, Debra was settled in favour of the petitioners by Patta Settlement Case No. 161/86-86. The petitioners alleged that the private respondent herein encroached upon a portion of the patta land forcefully. The petitioners submitted a representation before the Revenue Inspector, Debra and the Block Land & Land Reforms Officer, Debra praying for demarcation of the plot in question. Pursuant to the order dated 19th November, 2025 the District Land and Land Reforms Officer, Paschim Medinipur has filed the report dated 24th November, 2025 which is taken on record.

After going through the said report this Court finds that the Revenue Inspector conducted a detailed field enquiry over the plot in question in presence of the petitioners and the private respondent. Upon enquiry it was found that the writ petitioners are in possession over fifteen decimals of land where they have constructed a dwelling house and the private respondent is in unauthorised possession over three decimals of the suit land which is currently utilizing for agricultural purpose. The said report further states that no further steps could be taken by the respondents on account of pendency of writ petition being WPA 21186 of 2025.

The learned advocate appearing for the petitioners submits that the said writ petition has been filed by the petitioners alleging in action on the part of the police authority. He submits that the petitioners shall withdraw the said writ petition.

Such submission of the learned advocate for the petitioners is placed on record.

In the event the petitioners withdraw the said writ petition and intimates the Block Land and Land Reforms Officer, Debra, the respondent authorities shall take steps in accordance with law.

With the above observations and directions, WPA 25911 of 2025 stands disposed of.

There shall be however no order as to costs.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
