Present petition has been filed for expeditious disposal of the proceedings in Complaint Case being No. CN 03 of 2024 pending before the learned Metropolitan Magistrate, 11th Court at Calcutta under Sections 138 / 141 of the Negotiable Instruments Act, 1881.

Learned counsel for the petitioner submits that the opposite party has already appeared before the Ld. trial Court. However, for the last one year the application under Section 305 Cr.P.C. is pending disposal before the learned Metropolitan Magistrate, 11th Court at Calcutta. Learned counsel submits that appropriate directions may be issued for the expeditious disposal. 3.

The Court considers that no prejudice shall be caused to the opposite parties, if an appropriate direction is issued for expeditious disposal. The intention of the legislature is also to ensure that such matter is disposed of expeditiously. 4.

In the circumstances, learned Metropolitan Magistrate, 11th Court at Calcutta is directed to conduct the proceedings of

aforesaid complaint case under Sections 138 / 141 of the Negotiable Instruments Act expeditiously without granting any unnecessary adjournments in accordance with law. 5.

Accordingly, the petition stands disposed of. 6.
