Petitioner is directed to serve a copy of the revisional application upon Ms. Debjani Sahu, learned Advocate who ordinarily appears for the State. Her appointment may be regularized by the concerned authorities.

The grievance of the petitioner is that Debra P.S. case no. 81/19 dated 10.02.2019 which was registered for investigation for alleged commission of offence under IPC and POCSO Act is pending without any progress report being filed. Petitioner who happens to be the mother of the victim girl submits that an application under Section 173(8) of Cr.P.C./Protest Petition was preferred in the year 2019 and the same till date has been kept pending. The next date has been fixed by the Special Court on 01.12.2022. Learned Special Court would dispose of the said application for further investigation on the next date so fixed or within a fortnight. Thereafter no further time should be allowed in respect of the application under Section 173(8) of Cr.P.C. to be decided by the Court.

With the aforesaid observations CRR 4295 of 2023 is disposed of.
