The petitioner prays for implementation of the order of demolition passed by the Pradhan of the Gram Panchayat on September 23, 2022.

The Pradhan has forwarded the order of demolition to the Sub-Divisional Officer for implementation.

The Sub-Divisional Officer received copy of the order on February 7, 2023 but has still not taken any step to act in furtherance of the order passed by the Pradhan.

The Sub-Divisional Officer ought to have taken prompt necessary steps on receipt of the order passed by the Gram Panchayat. More than a year has elapsed but till date the Sub-Divisional Officer has not taken any steps in the matter.

In view of the above, the instant writ petition is disposed of by directing the Sub-Divisional Officer, Bardhaman (South) to act in furtherance of the communication made by the Pradhan on February 7, 2023 in accordance with law at the earliest but positively within a period of twelve weeks from the date of communication of this order.

Learned advocate for the petitioner is directed to forward a copy of this order passed by the Pradhan on September 23, 2022 and the communicating letter to the Sub-Divisional Officer on February 7, 2023 at the time of communicating the order of the Court.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
