Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 2 months. The investigation of the case has already been concluded and chargesheet has been submitted as also charge has been framed. Additionally, it has been submitted that three other accused persons who were arrested has been granted bail. Learned advocate appearing for the State submits that the petitioner is not similarly situated as the other accused persons who have been granted bail.
I have assessed the earlier order which reflects that from two of the accused persons there was no recovery and so far as the other accused person is concerned, the seizure list did not bear the signature of the said accused. However, the learned advocate for the State has produced the seizure list dated 24.09.2024 which reflects
the signature of the present accused and the recovery of FICN so effected from the petitioner.
Having regard to the nature of recovery so made, I am not inclined to release the petitioner on bail. Learned trial court is directed to expedite the progress of the trial and take the trial to its logical conclusion within a reasonable period of time. Accordingly, CRM(M) 2361 of 2025 is dismissed at this stage.
