Mr. Chatterjee learned Advocate appears for the petitioner is aggrieved by the order dated 27.07.2023 passed by the learned Chief Metropolitan Magistrate, Calcutta in C.S. 95842/2023. Records reflect that only cognizance had been taken on the complaint so alleged, process is yet to be issued. As such the revisional application which has been preferred is at a prematured stage.

The petitioner would be at liberty to approach this Court at the appropriate stage particularly if the learned Jurisdictional Court decides to exercise its power under Section 204 of the Code of Criminal Procedure.

With the aforesaid observations CRR 4291 of 2023 is disposed of.
