Mr. Ujjal Ray .....for the petitioner Affidavit of service filed in Court today is taken on record.

It is submitted by the Commissioner of School Education, Dr. Saumitra Mohan that the petitioner's recommendation for transfer has been sent to the School Service Commission by the D.I. of Schools (SE), Malda on February 24, 2023.

It appears from the extract of the Utsashree Portal that the petitioner ranked first in his second choice of school, i.e., Kalika High School. The application of the other two candidates is pending before the HOI.

In the above circumstances, the petitioner shall sit with the Chairman of the School Service Commission on Thursday (02.03.2023) at 2 p.m. The schools available, particularly, Kalika High School shall be considered for transferring the petitioner. If no vacancy is available in the Kalika

High School, the petitioner shall be accommodated in a school near his specified preference.

With the aforesaid observations, the contempt application shall stand disposed of. Rule, if any, shall stand discharged.

The personal presence of the Commissioner of School Education, Dr. Saumitra Mohan, is dispensed with.

There shall no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
