Learned advocate appearing for the petitioner submits that 386 bottles of phensedyl were recovered from the possession of the petitioner who is in custody for one year. Additionally, it has been submitted that 16 witnesses have been proposed to be examined by the prosecution in the charge-sheet so submitted, but till date none of the witnesses have been examined. Learned advocate appearing for the State opposes the prayer for bail.

However, having considered the period of detention of the petitioner and there is no possibility of the trial being concluded in near future, I am of the opinion that the prayer for bail of the petitioner be allowed.

Accordingly, the petitioner namely, Hasibul Sk @ Hasibul Sekh shall be released on bail upon furnishing bond of Rs.20,000/-

(Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Act-cum-Additional Sessions Judge, 2nd Court, under NDPS Act, Berhampore, Murshidabad. If on bail, the petitioner shall be physically present on each and every date of the trial and shall not leave the jurisdiction of the district of Murshidabad without the permission of the learned special court. Accordingly, CRM (NDPS) 1448 of 2025 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
