1. The present writ application has been preferred against an Investigation Report in File No.Misc.173/18/LC/KOL as pronounced on March 25, 2019 with a prayer to issue Failure Report under Section 12(4) of the Act, in File No.

Misc.173/18/LC/KOL within a specified time frame.

2. Written note of argument has been filed by the respondent nos.1 to 3 along with a report in the form of affidavit.

3. On hearing the learned counsel for the parties, it appears that the respondent no.4 Company has raised the issue that at present writ petitioner does not have locus standi as his registration have been cancelled.

4. It appears from the record that the petitioner at the time of filing the writ petition was a registered Trade Union. Vide an order dated 17.11.2021, the Registrar of Trade Union, Government of West Bengal has been pleased to cancel the registration of the petitioner herein with effect from the said date.

5. It appears that the proceeding before the Conciliation Officer was initiated by the said Registered Trade Union and being aggrieved by the decision of the Conciliation Officer, the writ application was also filed by the Registered Trade Union. But at this stage, the petitioner does not have any authority to proceed with the writ petition being admittedly not a registered Trade Union at present. As such, the writ application has now become infructuous and is thus, disposed of as infructuous.

6. Pending applications stands disposed of.

7. Interim order, if any, stands vacated.

8. Urgent Xerox certified copies of this order, if applied for, shall be supplied to the learned counsel for the parties as expeditiously as possible, in compliance of usual formalities.
