Rakib (Allowed) CRM (M) 2363 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Chinsurah Police Station case no. 21 of 2025 dated 24.01.2025 under Sections 420/406/467/468/471/120B & 409 of the Indian Penal Code. Learned advocate appearing for the petitioner submits that the petitioner is in custody for 274 days and charge-sheet has also been submitted before the jurisdictional Court, however, the prosecution proposes to furnish supplementary charge-sheet after the opinion of the Handwriting Expert is obtained. Learned advocate for the State opposes the prayer for bail and produces the Case Diary.

I have considered the list of documents as well as the witnesses relied upon by the prosecution. Having considered that there is no possibility of the trial commencing and/or concluding in near future, I am inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is allowed. As such, petitioner namely, Arnab Dutta shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty

Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Chief Judicial Magistrate, Chinsurah, Hooghly. If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of district of Hooghly without the prior permission of the learned Trial Court.

Additionally, if on bail, the petitioner shall meet with the investigating officer of the case once in every 10 days till the submission of supplementary charge-sheet before the jurisdictional Court.

Accordingly, the application for bail being CRM (M) No. 2363 of 2025 is allowed.

Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
