Petitioner has prayed for expeditious disposal of Complaint Case No. C 598 of 2012 before the learned Judicial Magistrate 6th Court, Alipore and is aggrieved under Section 138 of the Negotiable Instruments Act.

Learned Advocate submits that the proceedings are pending for the last 11 years and till date the cross-examination of the first prosecution witness is not over.

Having considered the intention of the legislature and the plight expressed by the petitioner I direct the Judicial Magistrate, 6th Court, Alipore to fix one day in a week from the next date so fixed so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. It is further directed in case the accused is reluctant to cross-examine on any ground which do not satisfy the conscience of the Court the learned Trial Court would impose a cost of Rs.10,000/- per day.

With the aforesaid observations CRR 4292 of 2023 is disposed of.
