The petitioner has been accused of kidnapping a minor girl and has been charged with offence under the POCSO Act. A complaint was registered in Kandi Police Station on 1st January 2023 resulting in registration of Kandi Police Station case no. 02 of 2023 dated 1st January 2023.

The petitioner says that he has been in custody for 156 days as on 1st October 2024. Charges have been framed and three witnesses have been examined till date.

After hearing the parties and considering the materials on record and keeping in mind the seriousness of the offence, particularly, involving a minor girl, we are not inclined to grant bail to the petitioner at this stage. This is more so that there

may be attempts to tamper with the evidence or intimidate the witnesses including the victim girl.

4. The application for bail is, thus rejected.

5. CRM (DB) 3550 of 2024 is accordingly dismissed. 6.
