Learned advocate appearing for the petitioner submits that the petitioner is in custody for six months and his name did not appear in the First Information Report. On the basis of a belated statement having been recorded, petitioner has been foisted with the present criminal case. Additionally, it has been contended that the petitioner is innocent of the charges and on any stringent conditions, he may be released on bail.

Learned advocate appearing for the State opposes the prayer for bail and submits that there is a motive which is on the face of the record appearing from the evidence and it is the petitioner allegedly who had engaged other accused persons which is the basis of the foundation of the prosecution case. Having considered the gravity of the case, I am not inclined to release the petitioner on bail at this stage.

Accordingly, CRM(M) 2364 of 2025 is dismissed at this stage.
