1. The petitioner submits that the petitioner sought for a new electricity connection but the same was not given.

2. Learned counsel for the West Bengal State Electricity Distribution Company Limited (WBSEDCL) files a written instruction wherefrom it is indicated that the petitioner was advised twice to seek a change in the name in respect of the meter which is already standing at the ancestral property of the petitioner where the petitioner has sought new connection. It is argued by the WBSEDCL that the petitioner has applied for such electricity connection in respect of a premise where there is an existing meter in the name of the deceased father of the petitioner.

3. Hence, if the petitioner applies for transfer of the name in respect of the meter in his name, subject to compliance of formalities, the WBSEDCL is willing to give the same.

4. Learned counsel for the petitioner submits that the petitioner's brothers are enjoying electricity from the said meter.

5. However, irrespective of the present user, since there is already an existing meter standing in the name of the petitioner's deceased father, the appropriate remedy of the petitioner is to apply for transfer of name.

6. Accordingly, WPA No. 25247 of 2023 is disposed of by granting liberty to the petitioner to apply for transfer of the existing electricity meter standing in the name of the deceased father of the petitioner in his name. If such an application is filed and due formalities are complied with by the petitioner, the WBSEDCL shall effect such transfer within a fortnight from such compliance of formalities.

7. The written instruction filed today be kept on record.

8. There will be no order as to costs.

9. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
