None appears for the private respondent nos.

Considering the plea taken by the respondentno.5 in its communication dated September 26, 2024 annexure p-5 at page-24 to the writ petition, the respondent no.5 is directed to forward the necessary records before the respondent no.6 forthwith but positively within a period of two weeks from the date of communication of this order.

Upon receiving the records from the respondent no.5, the respondent no.6 shall commence and conclude the proceeding under the relevant provision of Section 10 of the West Bengal Highways Act, 1964 in accordance with law but positively within a period of eight weeks from the date of receiving the records from the respondent no.5.

It is needless to mention that the respondent no.6 shall hold the proceeding upon prior notice of hearing to the petitioner and the private respondents.

Since affidavits are not called for, the allegations made in this writ petition are deemed not to have been admitted by the respondents. With the above observations and directions, this writ petition, WPA 26041 of 2024 stands disposed of, without any order as to costs.
