Kausik (Allowed) CRM (M) 2371 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/Section 439 of the Code of Criminal Procedure, 1973 in connection with Bankura Women Police Station Case No. 49 of 2025 dated 16.05.2025 under sections 85/117(2)/109/351(2)/351(3)/127(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023;

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 95 days. Charge sheet has already been submitted. It has been pointed out that earlier the application for anticipatory bail of the petitioner has been rejected.

Learned advocate for the State has drawn the attention of the Court to the injury report as well as the statement of the victim under Section 180 of the BNSS.

On an assessment of the overall facts of the case, I am inclined to release the petitioner on bail.

Petitioner, namely Achintya Kumar Dutta, shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only)

with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned CJM, Bankura.

If on bail the petitioner shall be physically present on each and every date fixed by the learned Court for the purposes of the present case. Petitioner shall stay outside the jurisdiction of Bankura Women Police Station and shall enter the jurisdiction of the said Police Station only after obtaining permission of the learned Court in seisin of the present case. Such condition would continue until and unless the learned Court in seisin of the present case or the learned Trial Court deems it necessary to waive the condition.

Accordingly, CRM (M) 2371 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
