The revisional application has been preferred along with the joint compromise petition as to whether wherein the petitioners and the private opposite party no. 2 intended to terminate the proceedings arising out of Kasba P.S. Case No. 92 of 2022 dated 16-03-2022.

The investigation of the said case concluded in a chargesheet and is pending before the learned Judicial Magistrate, 6th court, Alipore.

Earlier a report was called for. Mr. Paramanick, learned advocate for the State submitted a report before this court. Let the report be kept with the record. The report is enclosed with the statement and declaration of the opposite party no.2 which reflects that she do not intend to pursue the aforesaid case registered at

Kasba PS as she along with her husband separated and segregated her life and is leading a separate life of her own. Having regard to the contentions of the opposite party no.2 in the statement as well as the declaration and the fact that an amicable settlement has been arrived at between the parties, I am of the view further continuance of the criminal proceeding which arose out of a matrimonial dispute and discord may result in harassment to both the parties.

Accordingly, all further proceedings of Kasba Police Station Case No. 92 of 2022 dated 16-03-2022 wherein chargesheet was submitted under Section 498A/406/307/354A/34 IPC read with Section 4 of the D. P. Act and is pending before the learned Judicial Magistrate, 6th court, Alipore is hereby quashed. Accordingly, the revisional application being CRR 4299 of 2023 and CRAN 1 of 2023 is disposed of.

Pending any other applications, if any, are consequently disposed of.
