The present revisional application was preferred challenging the continuance of Durgapur Police Station Case No.

of dated 20.07.2021 under Sections 403/420/406/120B of the Indian Penal Code. During the pendency of this revisional application, there was amicable settlement between the parties and it was submitted on behalf of the petitioner that the complainant has informed him that he does not intend to proceed with the case. Accordingly, Ms. Sujata Das, learned advocate appearing for the State submits a report enclosing a statement and declaration of the de facto complainant. Let the said report dated 05.09.2023 be kept on record.

The said report reflects that the complainant viz. Somnath Garai is not interested to pursue with the present case being Durgapur Police Station Case No. 322 of 2021 dated 20.07.2021. Having regard to the nature of the transaction which has taken place and for which the criminal case was initiated, I am of the opinion that the same is private and personal in nature and no element of public policy is involved in the present case. Consequently, all

further continuance relating to Durgapur Police Station Case No. 322 of 2021 dated 20.07.2021 pending before the learned Additional Chief Judicial Magistrate, Durgapur and all subsequent orders passed therein are hereby quashed. Accordingly, the revisional application being CRR 4311 of 2022 is allowed.

Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
