Affidavit of service filed by the petitioner is taken on record.

The writ petitioner has stated that after entering into service with effect from 11th May, 2005, he has enhanced his qualification from B.P.Ed to M.P.Ed, in the year 2005 itself.

Therefore, on the basis of the enhanced qualification, he has sought for enhancement in the scale of pay, by submitting a representation dated 3rd December, 2018 before the District Inspector of Schools(Secondary Education), Jalpaiguri/respondent no. 4.

Mr. Biswas, learned advocate for the petitioner has indicated that the said representation of the petitioner is yet to be considered by the respondent authority. An order of this Court dated 20th December, 2024 in WPA 23788 of 2017 has also been relied on by Mr. Biswas.

So far as the State respondent is concerned receipt of the representation of the petitioner as above in its office has not been disputed.

Therefore, the present petition is disposed of by directing the respondent no. 4 to consider the petitioner's prayer vide representation dated 3rd December, 2018 and decide upon the same by dint of a reasoned order. In doing so, the respondent both shall afford opportunity of hearing to the petitioner and dispose of his prayer within six weeks from the date of communication of copy of this order.

Since no affidavit-in-opposition has been called for in this case, all allegations made in this writ petition are deemed to have been denied by the concerned respondent.

The writ petition is disposed of.
