It is submitted on behalf of the petitioner he is in custody for about five months. Co-accused has been enlarged on bail. Accordingly, he prays for bail on parity.

Learned Advocate for the State opposes the prayer for bail and submits petitioner had absconded for a protracted period of time. As a result, trial was delayed.

We have considered the materials on record. Petitioner had absconded for a considerable period. As a consequence, trial was delayed. Hence, we are not inclined to grant bail to the petitioner on parity.

The application for bail is thus rejected.
