Mr. Sohan Banerjee, holding the brief of Mr. Niladri Bhattacharjee, learned Counsel for the appellant prays that the present appeal may be dismissed as withdrawn with liberty to file a fresh appeal under the correct classification and before the appropriate forum.

In view of the aforesaid, the appeal is dismissed as withdrawn with liberty as prayed.
