Mr. Tapodip Gupta Mr. Suman Bhanja ....for the petitioner Mr. Bibaswan Bhattacharyya Mr. Subhasish Datta ....for the State Learned counsel appearing on behalf of the petitioner submits that on the previous occasion, the application for anticipatory bail was rejected as one of the Sections mentioned in the charge sheet was Section 70(2) of the BNS. However, from a careful perusal of the charge sheet, it would appear that as against the present petitioner the said charge has not been imputed.
In view of the above, the second application for anticipatory bail is found maintainable.
Heard the learned counsels for the parties.
Perused the case diary.
From the statements of the minor victim recorded before the learned Magistrate, it appears that the petitioner was the one who had kidnapped the minor and thereafter kept the child confined in a
room, whereupon the four other co-accused gang raped the minor child.
Considering the above and the other incriminating materials available in the case diary, the application for anticipatory bail is dismissed.
Accordingly, the application for anticipatory bail is rejected. (Jay Sengupta, J.)
