Learned Advocate on behalf of the State appears and submits that the matter pending since 2011 may be disposed of. This revisional application is directed against the order dated 29.9.2011 passed by the learned Judicial Magistrate, 2nd Court, Barrackpore in connection with M. Case No.390 of 2010 thereby granting an interim maintenance of Rs.1,500/- per month against the petitioner/husband underSection 125 of the Code of Criminal Procedure.
On careful perusal of the order impugned, I find that the learned Magistrate considering the interim maintenance application and written objection thereto came to his opinion that interim maintenance of Rs.1,500/- was sufficient during the pendency of the Misc. Case under Section 125 of the Code of Criminal Procedure. Learned Magistrate considered the admitted position of the marriage between the parties and their separate living and considering also the income of the
petitioner/husband, interim maintenance of Rs.1,500/- was granted.
I do not find any illegality, irregularity or perversity of the order itself. Thus, the order dated 29.9.2011 stands affirmed. Accordingly, the revisional application is disposed of. Let a copy of this order be communicated to the learned Judicial Magistrate, 2nd Court, Barrackpore for information. (Bibhas Ranjan De, J.)
