The learned IInd Bench of City Civil Court at Calcutta by the order impugned being Order No. 20 dated July 22, 2019 has vacated an interim order passed under Section 9 of the Arbitration & Conciliation Act, 1996 for the failure to the petitioner to refer the dispute between the parties to the arbitrator within the period stipulated under subsection (2) of Section 9 of the said Act of 1996. The order since is appealable under Section 37 (1) (b) of the said Act of 1996, the revisional application is not maintainable.

C.O. 4336 of 2019 is dismissed as such without any order as to costs.
