The petitioner claims to be serving as Headmaster in the Higher Secondary Section of a school. He was receiving 3% additional increment in terms of the Notification dated 4th December, 2014 till December 2023. He is due to retire from service on 31st December, 2026.

The additional increment that he was receiving has been abruptly stopped from January 2024 without disclosing any reason.

Prayer has been made to direct the respondents to continue paying 3% additional increment to the petitioner.

It appears that the petitioner is yet to raise a formal objection before the authority highlighting his grievances.

In view of the above, the instant writ petition stands disposed of with the observation that it will be open for the petitioner to make a formal representation before the District Inspector of Schools disclosing the memoranda relying on which he would be entitled to receive 3% additional increment.

In the event such a representation is made, the same shall be considered by the concerned District Inspector of Schools in accordance with law and in line with the order(s) passed by this Court from time to time.

A reasonable opportunity of hearing may be provided to the petitioner, if necessary.

8.

A reasoned order shall be passed and communicated to the petitioner.

9.

If the grievance of the petitioner is found to be proper, then necessary remedial steps shall be taken.

The writ petition stands disposed of.

11.

Urgent Photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
