C.R.R. 4189 of 2011 In the matter of : Miad Ali Molla & Ors.

... Petitioners.

Mr. Binay Kumar Panda, Ms. Pushpita Saha.

...for the State.

None appears on behalf of the petitioners.

Proper authority is requested to regularize the appointment of Mr. Binay Kumar Panda and Ms. Pushpita Saha, learned Advocates.

Learned Advocate on behalf of the State appears and submits that this revisional application is pending since 2012 and the petitioners even did not comply with the direction passed in the order dated 24.2.2012 by this Court by filing affidavit of service.

This revisional application is directed against the order dated 14.12.2011 passed by the learned Sessions Judge, Alipore whereby the learned Judge rejected the prayer for transfer of the case from the Fast Track 1st Court, Diamond Harbour to any other Court on the ground that the learned Advocate was not available in the Diamond Harbour Court.

So far as the order impugned is concerned, I do not find any illegality and/or irregularity therein. That apart, this revisional application is pending since 2012 but the petitioners are not taking steps even by filing of affidavit of service. Considering all facts and circumstances of the case, I do not find any reason to continue with this revisional application.

Accordingly, the revisional application stands dismissed. Let a copy of this order be communicated to the learned Additional District and Sessions Judge, Fast Track 1st Court, Diamond Harbour for information.
