Case No. 204 of 2023 dated 02.10.2023, although, the police authorities registered a case, but, no effective investigation has been done, as there has been no recovery of the stolen jewellery, as has been alleged in the complaint.

The petitioner claims that he has list of items.

Learned advocate for the State has submitted a report, which reflects that

pursuant to the complaint of the petitioner, charge-sheet has been submitted before the learned jurisdictional court.

Be that as it may, the petitioner is granted liberty to file an application under Section 173(8) of the Cr.P.C. before the learned jurisdictional Court enclosing the list of items, which he apprehends, in all probabilities, was there.

Since the petitioner claims that all the documents including the gold jewelleris were stolen from which this case has been initiated, in case, such an application is preferred before the learned jurisdictional Court, the jurisdictional Court will dispose of the application under Section 173(8) of the Cr.P.C. preferably within 45 days from the date of filing of such application.

With the aforesaid observations, WPA 25297 of 2023 is disposed of.

Report so submitted be kept with the record.

Supplementary Affidavit so filed be also kept with the record.
