Petitioner is in custody for over 260 days. He submits he has been falsely implicated in the instant case. He prays for bail.

Learned Advocate for the State opposes the prayer for bail.

Statements of eye witnesses recorded under Section 164 of the Code of Criminal Procedure implicate the petitioner in the crime. Their ocular version is corroborated by post mortem report.

Under such circumstances and gravity of the offence, we are not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected.
