In Re : An application under Article 227 of the Constitution of India; In the matter of : Dilip Tarafder. ...petitioner. The present revisional application was preferred against the order dated 28th August, 2012 passed by the learned Judicial Magistrate, 7th Court, Alipore in connection with M. Case No.578 of 2003 (TR No.816 of 2005). The said order reflects that the point which was canvassed before the learned Magistrate was earlier agitated before the learned Additional District and Sessions Judge, Fast Track, 8th Court, Alipore in Criminal Revision and the same was allowed.

Having regard to the fact that no substantial question of law is involved in the instant case, I am of the view that there is no scope for interference at this belated stage when the order-sheet reflects that the date of evidence was fixed on 13th December, 2012. Accordingly, CRR 3488 of 2012 is dismissed.

Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
