1. Learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to place the material before the learned Appellate Court regarding the occupational charges.

Learned counsel for the petitioner states that similar property is fetching rent at the rate of Rs.5000/- per month.

2. Let the learned Appellate Court consider the material being produced by the learned counsel for the petitioner.

3. Learned counsel for the petitioner may revise the occupational charges if the credible documents are placed.

4. The Court shall also give opportunity to the learned counsel for the opposite party / judgment debtor to make submissions and counter-submissions. The question regarding revision of quantum of occupational charges is left open to be determined at the time of disposal of the final appeal.

However, in the meantime the opposite party / judgment debtor shall continue to comply with the order dated 26th September, 2023.

5. Hence, the petition stand disposed of.

6. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
