The petitioner seeks transfer on special ground. She claims to be suffering from gynecological issues. Her husband is posted 140 kilometers away from her workplace.

From the documents annexed to the writ petition, it appears that the application of the petitioner was returned by the head of the institution with the remark 'unwilling to transfer'. No specific ground has been mentioned as to why the petitioner's application will not be proceeded further.

The unreasoned remark by the head of the institution is not tenable in the eye of law. 5.

In view of the above, the ground for returning the application of the petitioner cannot be accepted. The same stands set aside.

The head of the institution is directed to reconsider the petitioner's application strictly in accordance with the prevailing transfer rules and guidelines and to take a decision in the matter at the earliest but positively within a period of eight weeks from date of communication of this order.

In the event the petitioner relies on medical ground for transfer, then the medical examination of the petitioner shall be duly conducted.

The writ petition stands disposed of.

All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.

10. Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
