Learned Counsel for the petitioner submits he has not been identified by PWs 1 and 2. He prays for bail. 2.

Learned Counsel for the State opposes the bail prayer and submits Papai Sen and Sukhen Das identified the petitioner in the course of T.I. parade examination. They are yet to be examined.

We have considered the materials on record.

Statements of witnesses read with T.I. parade examination demonstrate petitioner had fired at the victim. As a result she died. Two most vital witnesses have not been examined till date. In view of the aforesaid status of trial and gravity of the offence we are not inclined to grant bail to the petitioner at this stage.
