Heard the learned counsel for the parties.

State has appeared and submitted a report, wherein it appears that in spite of being directed, the petitioner has not appeared before the Panchla Police Station but sent a representative. The petitioner has also been directed to file a fresh complaint but he submitted a representation where he requested the respondent no.4 who treated the same as an FIR. The police has registered a G.D. entry in respect of the said complaint and an enquiry was conducted and a gift deed was produced in respect of the property in this case. It further appears that a Title Suit being 1224 of 2023 is pending between the learned Civil Judge (Junior Division), 1st Court, Howrah and an interim order of injunction is subsisting in the said case.

On thorough enquiry and on a proper interrogation, the police has filed the present report. From the said report it appears that there is prima facie no police inaction in the present case. The dispute in the present case is prima facie civil in nature.

Considering the fact, the writ petition stands dismissed. However, there shall be no order as to costs. [Shampa Dutt (Paul), J.]
