Case No.675 of 2025 dated 05.10.2025 under Sections 137(2)/140(3)/3(5) of the BNS, 2023. And In the matter of:

APP Mr. Atif Ahmed Siddiqui ... for the State Learned counsel for the petitioners submits that the petitioners are the parents and the brother of the principal accused. It is alleged that the principal accused had kidnapped the minor daughter of the de facto complainant. Learned counsel for the State strongly opposes the prayer for anticipatory bail and refers to the statements of witnesses.
It appears that there are serious allegations against the brother being the petitioner No.3 for assisting the principal accused in kidnapping the minor girl. Reliance is placed on the statements made by witnesses present at page 11 of the case diary.
Considering the above and the other materials available in the case diary, while I am inclined to grant anticipatory
bail to the petitioner Nos.1 and 2, the application for anticipatory bail of the petitioner No.3 (Manik Chandra Barman) is rejected.
In the event of arrest, the petitioner Nos.1 and 2 (Manindra Nath Barman and Mina Roy Barman)) shall be released on bail upon furnishing a bond of Rs.10,000/- (rupees ten thousand) each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on the further conditions that the petitioner Nos. 1 and 2 shall cooperate with the investigation, shall not threaten or intimidate witnesses and the petitioner No.1 shall meet the investigating officer once a week till submission of report in final form.
The application for anticipatory bail is, thus, disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
