CRM No.12198 of 2019 with CRAN No.1 of 2021 (Via video conference) 28.07.21 (S.R.) Sl.29 Ct.30 In Re: An application for relaxation of condition of bail. And In re: Lalu Sk & Anr.

... petitioners.

Mrs. Karabi Roy ... for the petitioners.

Mr. Anwar Hossain Mr. Narayan Prasad Agarwal Ms. Sreyasree Biswas ... for the State.

The present application has been preferred praying for relaxation of the conditions of bail, as incorporated in the order dated 23rd December, 2019 passed in CRM No.12198 of 2019. Mrs. Roy, learned advocate appearing for the petitioners herein submits that the petitioners have complied with all the conditions, as incorporated in the order dated 23rd December, 2019 till date. The petitioners are day labourers and they lose their earnings on the dates they meet with the officer-in-charge of Tehatta P.S. Mr. Hossain, learned advocate appearing for the State opposes the petitioners' prayer. However, he does not dispute the fact that the petitioners have complied with the conditions, as incorporated in the order dated 23rd December, 2019. A copy of the report, as filed, be kept on record.

A perusal of the said report reveals that in the year 2018 Tehatta police Station was bifurcated in two police stations, namely, Tehatta police station and Palashipara police station. After such bifurcation the house of the petitioner falls under Palashipara police station. There is no adverse report against the petitioners and since they

have complied with the earlier conditions till date, the condition, as incorporated in the order dated 23rd December, 2019 passed in CRM No.12198 of 2019, to meet with the officer-in-charge of the Palashipara police station, is waived.

The other conditions, as imposed, shall remain unaltered. The application being CRAN No.1 of 2021 is, accordingly, disposed of.

All parties shall act on the server copies of this order duly downloaded from the official website of this Court. (Subhasis Dasgupta, J.) (Tapabrata Chakraborty, J.)
