Petitioner submits that he has been subjected to extortion and was assaulted when he refused to succumb to the demand of the private respondents.

Information were furnished before the police authorities because of the overt act and actions of the private respondents.

Learned advocate for the State has submitted a report. The report reflects that Baranagar P.S. was prompt in registration of the FIR and subsequently submission of charge sheet.

Learned advocate for the State has submitted that a case has already been initiated by the respondent no. 6 which has also resulted in the charge sheet.

Having considered the report submitted on behalf of the State, I am of the view that the police authorities at appropriate stages have taken steps.

Learned advocate for the private respondents submits that the accusation so made in the writ petition

as also the criminal cases which have been registered at the behest of the petitioner are false, frivolous and has been initiated because of private and personal grudge. I have considered the contentions advanced by the petitioner, the State and the private respondents. On an assessment of the same, I am of the view that presently there is no cognizable offence which has been committed and at the relevant point of time, police has taken appropriate steps.

I direct that in case there is any possibility of any untoward incident, police authorities would act properly and will continue to keep strict vigil because of the inimical relationship existing between the parties. Report so submitted be kept with the records. With the above observations, WPA 25350 of 2023 is disposed of.

There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this court.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
