It is alleged that the private respondents have carried out unauthorized and illegal construction without obtaining any lawful permission.

The private respondents are represented and submit that all necessary permissions have been obtained and the requirement for mandatory open space has also been complied with.

In view of the submissions made on behalf of the parties, W.P.A. No. 26242 of 2024 stands disposed of by directing the respondent no. 7, being

the Pradhan, Mughberia Gram Panchayet, DistrictPurba Medinipur, to consider and dispose of the representation of the petitioner dated June 14, 2024 expeditiously and preferably within a period of eight weeks from the date of communication of this order and after giving a right of hearing, if necessary, to all the affected parties.

The State of West Bengal is represented and does not object to the passing of the above order. It is made clear that there has been no adjudication on the merits of the case and the respondent no.7 is to act strictly in accordance with law.
