The Officer-in-charge, Kaliganj Police Station has not filed any report despite the order dated 10th January, 2023.
Counsel for the petitioner/mother submits that her daughter is now living with her father, namely, Paritosh Hazra and there are proceedings under the Guardians & Wards Act pending before the concerned Court with regard to the custody of the child. In that view of the matter, it would be inappropriate to continue with the instant proceeding. The petitioner may pursue all remedies under the Guardians & Wards Act for custody of her daughter in accordance with law.
The Court below, seized of the said proceedings, shall deal with the same strictly in accordance with law uninfluenced by any statements made in the instant writ petition or the order of this Court.
With the aforesaid directions, the instant writ petition shall stand disposed of.
There will be no order as to costs.
