1. It is submitted on behalf of the petitioner that he has been falsely implicated into the case.

2. Other co-accused persons have been granted bail by the Court below.

3. He is in custody for 36 days. Accordingly, he prays for bail on any terms and conditions.

4. On the other hand, Learned Advocate for the State has opposed the prayer for bail and submits that he was absconded for six years.

5. Charge-sheet has already been submitted and other co-accused has been enlarged on bail.

6. We have considered the materials on record as well as considering the stage of the proceeding and other co-accused on bail, we are inclined to grant the prayer for bail to the petitioner.

7. Therefore, the accused/petitioner, namely Ranajit Saha @ Ranju Saha, be released on bail upon furnishing a bond of Rs.10,000/-

(Rupees Ten thousand only), with two sureties of like amount each, to the satisfaction of the learned Additional Chief Judicial Magistrate, Barrackpore, North 24 Parganas and with a further condition that the said petitioner shall appear each and every date before the trial court.

8. In the event, he fails to appear before the trial court without justifiable cause, the trial court shall be at liberty to cancel his bail in accordance with law without reference to this court.
