In the 10th year of the Title Suit No.342 of 2015, which is pending before the learned Civil Judge (Jr. Divn.), 1st Court, Contai, Purba Medinipur, the plaintiff has filed an application for amendment of the plaint. Prior to such application, an application was filed under Order 22 Rule 10 to add Sea Foods Private Limited as a defendant. As the application under Order 6 Rule 17 is still pending, the prayer of the petitioner for expeditious disposal of the suit cannot be granted.

The learned Court is requested to dispose of the application for amendment of the plaint within a period of three months from the next date fixed, strictly in accordance with law. Thereafter, the learned Court shall make an endeavor to proceed with the suit expeditiously.

This court has not expressed any opinion on the merits of the application. The learned court shall

proceed independently and in accordance with law.

A copy of the revisional application along with a server copy of this order be served upon the opposite parties and/or the learned advocate contesting the matter on behalf of the opposite party in the learned court below, within a week. 5.

Affidavit-of-service to be filed before the Court below.

The revisional application is accordingly disposed of. There shall be no order as to costs.
