Pursuant to the receipt of notice, Ms. Baisali Basu, learned advocate for the State has appeared on behalf of State-respondent.

Mr. Satadru Lahiri appears and submits on behalf of the Opposite Party/respondent-accused in the matter, who undertakes to file 'vakalatnama'.

Now upon hearing the learned advocate for the parties. Considering sufficient explanation offered in the application under Section 5 of the Limitation Act for delay of three days in preferring special leave, delay is condoned. Hence, the special leave to appeal is granted to the petitioner/appellant under the provision of Section 378(4) of the Code of Criminal Procedure.

Thus, CRMSPL 63 of 2019 is disposed of.
