Kausik (Allowed) CRM (M) 2387 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kakdwip Police Station Case No. 49 of 2025 dated 11.03.2025 under Section 105 of the BNS, 2023;

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 263 days. Petitioner is the grandson of the deceased. The primary accusation is in respect of a single blow being inflicted with fist at the spur of the moment.

Learned advocate for the State has produced the case diary. Attention of the Court was drawn to the post-mortem report as well as the evidence of the witnesses. I find that charge sheet has been submitted under section 105 of the BNSS. The case has already been committed to the Court of Sessions. Having considered the same, I am of

the opinion that further detention of the petitioner is unwarranted.

Accordingly, the prayer for bail of the petitioner is allowed.

Petitioner, namely, Ananda Chakraborty shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of ACJM, Kakdwip. If on bail the petitioner shall be physically present on each and every date fixed by the learned Trial Court. Petitioner shall not leave the jurisdiction of ACJM, Kakdwip without leave of the learned Trial Court.

Accordingly, CRM (M) 2387 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
