By initiating this contempt proceeding, applicants have alleged that order passed by a Coordinate Bench on 15th September, 2023 has been violated by not releasing arrear payment to the petitioners within specified time.

Today, an affidavit of compliance has been filed on behalf of alleged contemnors and same is taken on record. A copy of affidavit of compliance is made over to learned advocate representing the applicants.

It has been submitted by Mr.

Chattopadhyay, learned Additional Government Pleader appearing on behalf of alleged contemnors that payment has been made to the

applicants in terms of order dated 15th September, 2023 in spite of fact that in terms of order dated 15th September, 2023 bills were not raised through registered society under the Society Registration Act. In order to comply with the order dated 15th September, 2023, alleged contemnors had to pay individually to the applicants.

Learned advocate representing the applicants disputes quantum of payment individually made to the applicants and it is also submitted that for the month of September, 2023 payment was not made.

Having considered the fact that payments have been made as it appears from documents annexed to affidavit of compliance filed today from page 38 onwards, present contempt application stands disposed of and contempt proceeding stands dropped.

However, this order shall not preclude the applicants to take step in accordance with law disputing quantification of payment and making prayer for release of further payment, if they are so entitled.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
