C.R.R. 3012 of 2013 (Via Video Conference) Uttam Das versus Smt. Jharna Das In Re: An Application under Sections 401 and 482 of the Code of Criminal Procedure.

The present revisional application has been preferred against an order dated 24.05.2013 passed by the learned Judicial Magistrate, 1st Court, Contai in connection with Misc. Case No. 221 of 2012 under Section 125 of the Code of Criminal Procedure.

The impugned order reflects that an amount of Rs.2000/- per month was awarded by way of interim maintenance to the wife/opposite party. Having regard to the fact that the order was passed by way of interim measure during the pendency of the final disposal of the proceedings under Section 125 of the Code of Criminal Procedure, I am of the view that the same does not call for any interference. As such, CRR 3012 of 2013 is dismissed.

Interim order, if any, is hereby vacated.

All pending applications, if any, are consequently disposed of.

The wife/opposite party will be at liberty to take out appropriate application for recovery of arrears before the learned Judicial Magistrate.
