The main contention of the petitioner is that the petitioner was directed to be produced on 21st of October, but, he was never produced before the learned Special Court and/or the learned CJM and/or the learned Magistrate in charge.

The petitioner, as such, has contended in the present application under Article 226 of the Constitution of India that the detention of the petitioner is illegal.

Be that as it may, the petitioner, presently, is in custody pursuant to the order passed by the learned Special Court.

If the petitioner is aggrieved by any order of the learned Special Court, the learned jurisdictional revisional court having determination to assess regarding the legality and/or illegality of the said order would consider the same.

Accordingly, the petitioner is granted leave to canvass such issues before the appropriate forum.

With the aforesaid observations, WPA 26430 of 2024 is disposed of.
