The writ petitioner complains that the private respondents have, in process of filling up of a nearby pond, allowed water to flow into their residential house. The private respondents are causing public nuisance. Kulti Police Station has filed a report dated 06.12.2022 addressed to State advocate and the same is taken on record.

The police have taken out proceedings under Section 107 and 116(3) of the Cr. P. C. The dispute between the parties is purely civil in nature. Kulti Police shall, however, ensure that there is absolutely no breach of peace in the area and shall maintain regular vigil thereat.

The writ petition is disposed of.

There will be no order as to costs.
